Terms of Use (ToU)

The Website provides Users with access to the following services:

• Data transfer between the Client's real estate CRM and its website(s) (Real Estate Gateway)
• Migration of real estate data between CRM systems
• Management of contacts generated by the Client's website(s)
• Delegated management of these Services by a web agency on behalf of a real estate Client

The Website is a product of Ts-Services. Ts-Services grants Users a limited, revocable, non-exclusive and non-transferable right to access the Services, for strictly personal or professional use in accordance with the subscribed plan.

Any use of the Website contrary to its purpose or to these Terms of Use is strictly prohibited.

Access to the Website is open to any natural or legal person. Certain services are reserved for registered Users (particularly paid services).

Ts-Services reserves the right to suspend or deny access to one or more Users without prior notice or compensation, in particular where these Terms of Use are breached.

Use of the Website requires an internet connection and an up-to-date browser. All necessary equipment remains the User's sole responsibility.

Upon registration, the User undertakes to provide accurate, truthful and up-to-date information. Providing false information may result in immediate account suspension.

The User is responsible for the confidentiality of their login credentials and for all activity carried out from their account. In the event of suspected compromise, the User must immediately notify Ts-Services at support@ts-immo.org.

Any registered User may request account deletion by writing to support@ts-immo.org. Ts-Services will process the deletion as soon as reasonably practicable.

Personal data of inactive accounts is deleted after 36 months without login.

Ts-Services implements the technical solutions necessary to ensure continuous access to the Website. However, Ts-Services reserves the right to limit, suspend or interrupt access to all or part of the Website at any time, in particular for:

• Maintenance and technical updates
• Security reasons
• Force majeure events

Such interruptions shall not give rise to any compensation.

5.1 — Prohibited Conduct

Users expressly undertake not to:

• Transmit, publish or distribute any defamatory, abusive, obscene, violent, racist or discriminatory content
• Infringe the intellectual property rights of Ts-Services or third parties
• Create links to or reference the Website's content without Ts-Services' prior written consent
• Use information, content or data from the Website to offer a service competing with Ts-Services
• Sell, exchange or monetise data from the platform without Ts-Services' express written consent
• Engage in reverse engineering, decompile, disassemble or attempt to obtain source code from any Website software
• Use bots, scripts or any automated tool to access, crawl, extract or index the Website
• Attempt to compromise the security of Ts-Services' systems or networks
• Transmit or activate computer viruses or any malicious code via the Website
• Counterfeit or misuse Ts-Services' products, logos, trademarks or any protected element

5.2 — Editorial Responsibility

The User is solely responsible for content and data transmitted via the Website. The User warrants that they hold all necessary rights over such content and that it does not infringe any third-party rights.

All Website content (designs, texts, graphics, images, videos, logos, icons, software, audio files) is the exclusive property of Ts-Services or its partners, protected by applicable intellectual property laws.

Any reproduction, representation or exploitation, in whole or in part, without Ts-Services' prior written authorisation, is strictly prohibited and may result in legal proceedings.

The processing of Users' personal data is governed by Ts-Services' Privacy Policy, available at www.ts-immo.org/confidentialite, which forms an integral part of these Terms of Use.

Users have the rights recognised under the GDPR (access, rectification, erasure, restriction, objection, portability), exercisable at: rgpd@ts-immo.org. All requests receive a response within thirty (30) days.

Ts-Services does not warrant uninterrupted or error-free operation of the Services. Ts-Services' liability shall not be engaged in the event of:

• Interruption for maintenance, updates or technical improvements
• Internet network failures or User equipment malfunctions
• Indirect or unforeseeable damage (loss of revenue, data or customers)
• Force majeure events within the meaning of Article 1218 of the French Civil Code

In all cases, Ts-Services' liability is limited to direct damages only, under the conditions set out in the GTC.

Ts-Services' computer systems and files constitute evidence between the parties. Ts-Services may validly produce, in any proceedings, data, files, access logs and records maintained by its systems.

If any provision of these Terms of Use is declared void or unenforceable, the remaining provisions shall remain in force to the fullest extent permitted by law.

These Terms of Use are governed by French law.

In the event of a dispute, the parties undertake to seek an amicable resolution before initiating legal proceedings. Users may also have recourse to alternative dispute resolution (conventional mediation, etc.).

Failing amicable resolution, the dispute shall be submitted to the exclusive jurisdiction of the French courts.

These Terms of Use are entered into for an indefinite period, from the moment the User begins using the Website.

Ts-Services reserves the right to amend these Terms of Use at any time. Registered Users are informed of any update by publication on the Website and by email. Continued use of the Website after modification constitutes acceptance of the updated Terms of Use.
